By accessing tutorgem.com, creating an account, booking a tutoring session, enrolling on a course, using our AI tutor tools, or contacting our team — you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions and our Privacy Policy.

These Terms may be updated periodically. Continued use of TutorGem after any changes constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email.

TutorGem is an online tutoring and educational technology platform based in Islamabad, Pakistan. We operate globally, providing the following core services:

TutorGem acts as a platform connecting students and parents with qualified independent tutors. We are not an employer of tutors but a marketplace and management platform facilitating tutoring relationships.

To use TutorGem’s services, the following eligibility requirements apply:

• Students aged 13 and above may register independently. Students under 13 must have an account managed by a parent or legal guardian.
• Students under 18 must have written or digital consent from a parent or legal guardian before engaging private tutors.
• Tutors must be 18 years or older, hold relevant qualifications, and pass our verification process before being listed on our platform.
• All users must provide accurate, truthful, and up-to-date information when registering. Providing false information will result in immediate account termination.
• TutorGem services are available to users in all countries subject to applicable local laws and regulations.

TutorGem provides the following services subject to availability, tutor capacity, and these Terms:

TutorGem reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice to affected users.

5.1 Account Registration

• You must provide accurate and complete information when creating your TutorGem account.
• You are responsible for maintaining the confidentiality of your account password.
• You must notify us immediately at online@tutorgem.com if you suspect any unauthorised access to your account.
• One person may hold only one account. Creating multiple accounts is not permitted without prior written consent.

5.2 Account Responsibility

• You are fully responsible for all activity that occurs under your account.
• TutorGem is not liable for any loss or damage arising from your failure to maintain account security.
• Accounts must not be shared with or transferred to another person.

All tutors listed on TutorGem are subject to the following standards and verification requirements:

• Submission of valid academic qualifications relevant to their subject and teaching level
• Identity verification using a government-issued photo ID
• Background checks for tutors working with students under 18
• Agreement to TutorGem’s Tutor Code of Conduct before being listed on the platform
• Completion of a trial session assessment for quality assurance
• Ongoing performance monitoring through student and parent feedback reviews

7.1 Booking a Session

• Sessions are booked through TutorGem’s platform or by contacting our team via email or WhatsApp.
• All bookings are subject to tutor availability and confirmed only upon receipt of payment or booking confirmation.
• Session schedules are agreed between the student/parent and tutor at the time of booking.
• TutorGem is not responsible for scheduling conflicts arising from errors in time zones when booking internationally.

7.2 Session Conduct

• Both students and tutors must behave respectfully and professionally during all tutoring sessions.
• Sessions must be conducted through TutorGem-approved platforms only. Direct payment or contact outside the platform is a violation of these Terms.
• Recording of sessions is permitted only with the prior written consent of all parties involved.
• Students and parents must not request tutors to complete coursework, assignments, or examinations on behalf of students, as this constitutes academic dishonesty.

8.1 Pricing

TutorGem’s tutoring fees are displayed on the relevant subject and course pages. Prices are quoted in USD and may vary by subject, tutor experience level, and session duration. We reserve the right to update our pricing with reasonable advance notice.

8.2 Payment

• Payment is due at the time of booking unless a payment plan has been agreed in writing.
• We accept payment via our secure third-party payment providers. Card details are never stored on TutorGem’s servers.
• All transactions are processed in USD. International users may be subject to currency conversion fees charged by their bank.
• TutorGem issues a booking confirmation and receipt for all successful payments.

8.3 Tutor Payments

• Tutors are compensated according to their agreed rate minus TutorGem’s platform service fee.
• Tutor payments are processed after each confirmed and completed session.
• Disputed sessions or sessions subject to a refund claim will be held pending resolution.

To request a cancellation or refund, contact us at online@tutorgem.com. All refund requests are reviewed within 5 business days. Approved refunds are processed within 7–10 business days to the original payment method.

You May:

• Use TutorGem’s platform for legitimate academic tutoring, exam preparation, and learning support
• Browse tutor profiles, read reviews, and select tutors for GCSE, A-Level, IGCSE, and other academic purposes
• Use our AI tutor tools for personal study, revision, and exam practice
• Share feedback and reviews about tutors to help other students and parents
• Contact TutorGem’s support team with genuine enquiries about tutoring services

You Must Not:

• Use TutorGem’s platform for any unlawful, fraudulent, or harmful purpose
• Post false, misleading, defamatory, or offensive content, reviews, or communications
• Attempt to bypass or circumvent our payment system by arranging direct payment to tutors outside the platform
• Reproduce, distribute, or commercially exploit any content from tutorgem.com without written permission
• Use automated tools, bots, or scrapers to extract data from the TutorGem platform
• Impersonate another user, tutor, parent, or TutorGem staff member
• Upload or share any content that infringes on copyright, trademarks, or intellectual property rights
• Engage in academic dishonesty including requesting tutors to complete work on your behalf
• Share, disclose, or misuse the personal information of tutors, students, or other users

All content on tutorgem.com — including but not limited to text, images, logos, graphics, course materials, AI-generated content, learning resources, and platform software — is the exclusive intellectual property of TutorGem or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

• TutorGem Name & Logo: The TutorGem name, logo, and brand identity may not be used without our prior written consent.
• Course & Learning Materials: All tutoring materials, worksheets, practice papers, and AI-generated study tools created by TutorGem remain our intellectual property.
• Tutor-Created Content: Content created by tutors during sessions or shared via the platform is subject to a non-exclusive licence granted to TutorGem for platform use.
• User Submissions: Reviews, feedback, and messages submitted by users grant TutorGem a non-exclusive right to display and use such content for platform improvement.
• Permitted Use: You may access and use TutorGem’s content for personal, non-commercial educational purposes only.

TutorGem provides AI-powered learning tools including practice paper generators, quiz tools, and adaptive study assistants. By using these tools, you agree to the following specific terms:

• Educational Purpose Only: AI tutor tools are provided for personal study and learning support. They must not be used to generate content for submission as your own academic work.
• No Guarantee of Accuracy: While our AI tools are designed to provide accurate educational content, TutorGem does not warrant that AI-generated content is error-free. Always verify important information with a qualified human tutor.
• No Replacement for Human Tutors: AI tools are supplementary to — not a replacement for — the expertise of our qualified tutors. Results in examinations depend on genuine student effort and understanding.
• Data Use: Interactions with AI tutor tools are processed to improve tool accuracy. See our Privacy Policy for full details on how AI interaction data is handled.
• Beta Features: Some AI features are in beta and may change, be discontinued, or produce unexpected results. TutorGem is not liable for any learning outcomes arising from sole reliance on beta AI features.

TutorGem is committed to the highest standards of safeguarding for all students, particularly children and young people under the age of 18. The following safeguarding policies apply to all platform users:

• All tutors working with minors must complete a background check and provide proof of safeguarding awareness training.
• Parents or guardians of students under 18 must be the account holder and are responsible for monitoring session activity.
• Tutors must not communicate with minor students outside of TutorGem’s approved platforms or via personal contact details.
• Any behaviour that makes a student uncomfortable must be reported to TutorGem immediately at online@tutorgem.com.
• TutorGem reserves the right to monitor sessions involving minors for safeguarding compliance.
• Any concern about the welfare of a child using TutorGem’s platform will be escalated to the appropriate authorities without delay.

14.1 No Guarantee of Results

TutorGem does not guarantee any specific academic outcome, examination result, or grade improvement as a result of using our tutoring services. Results depend on individual student effort, engagement, and external factors beyond our control.

14.2 Platform Availability

We strive to maintain 99%+ platform uptime but do not guarantee uninterrupted access to tutorgem.com. We are not liable for losses arising from temporary platform unavailability, technical failures, or scheduled maintenance.

14.3 Third-Party Services

TutorGem uses third-party video conferencing, payment, and communication tools. We are not liable for failures, data breaches, or service interruptions caused by these third-party providers.

14.4 Limitation of Liability

• TutorGem’s total liability for any claim arising from use of our services is limited to the amount paid by the user for the specific session or service in dispute.
• We are not liable for indirect, consequential, special, or punitive damages arising from use of our platform.
• Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.

15.1 Termination by TutorGem

TutorGem reserves the right to suspend or permanently terminate any user account at any time and without prior notice for:

• Violation of any part of these Terms and Conditions
• Fraudulent activity, misrepresentation, or provision of false information
• Academic dishonesty or misuse of AI tutor tools
• Inappropriate, abusive, or threatening behaviour toward tutors, students, or staff
• Bypassing the payment system or arranging off-platform payments
• Any safeguarding concern involving a minor
• Any activity deemed harmful to TutorGem’s reputation or other users

15.2 Termination by User

You may close your TutorGem account at any time by contacting us at online@tutorgem.com. Upon closure, outstanding sessions and payments will be honoured but no new bookings can be made. Data will be retained as described in our Privacy Policy.

These Terms and Conditions are governed by and construed in accordance with the laws of Pakistan. For users in the United Kingdom, consumer protection laws of England and Wales apply where they provide greater protections than these Terms.

16.1 Dispute Resolution

• Step 1 — Contact Us First: All disputes should first be raised with TutorGem directly at online@tutorgem.com. We aim to resolve all disputes within 14 business days.
• Step 2 — Mediation: If a dispute cannot be resolved directly, both parties agree to attempt mediation before pursuing formal legal action.
• Step 3 — Legal Action: Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Islamabad, Pakistan, or the relevant courts in the user’s country of residence where mandatory consumer law requires.
